Conditions of use

1. Scope

These terms and conditions govern the contractual relationship between Christian Moore (owner of MOORE DENIM) and the natural and legal persons (customers) who use the online shop. Different conditions of the buyer are not acknowledged.

The acceptance of these terms is performed during the ordering process and they are directly included in the contractual relationship between the two parties. The sales contract is subject to German general commercial law. Minors are excluded from registration in the MOORE DENIM Online Shop.

2. Offer and Conclusion

In the MOORE DENIM Online Shop, customers with a delivery address within Germany, Belgium or the Netherlands can order clothes from Christian Moore. An order is binding with costs. Clients are advised to check the right of withdrawal and the exclusion of it in certain cases. There are various types of orders:

2.1 Individual production in standard size

The order will be custom made according to options selected by customers and the chosen size. Customers are advised to compare personal measurements with the MOORE DENIM size charts.

2.2 Tailor-made clothes

If clients select the size option “Tailored to customer's measurements”, the order will be custom made according to options selected and customer dimensions. An individual length at trousers and jackets is only possible in combination with the option “Tailored to customer's measurements” at width. (Orders with this option selected only at length will be corrected or cancelled after consulting the customer.)

The production is based on the measurements of the customer, which will be taken by the customer. The instructions can be downloaded from the page Tailor-made and will be sent after the ordering process in the confirmation e-mail, too. Christian Moore accepts no liability for customers providing false information.

Pattern creation is bound to a service fee. At following orders, the production according to this pattern is free of charge, as long as the pattern doesn't have to be altered (e.g. because customer's measurements have changed). Measurements and patterns will be stored five years after your last order. After that, measurements and patterns have to be renewed at corresponding costs.

2.3 Ordering of garment in stock

Customers can also order pre-fabricated designs (if in stock).

3. Prices and shipping costs

All prices and shipping costs on www.mooredenim.com are in Euros including the statutory value added tax.

4. Ordering process

During the checkout process, customers define in two steps the delivery and invoice address along with the payment method. All order details will be shown in the third step before the purchase is completed.

Customers receive the order confirmation by e-mail right away and will be notified about changes of the order status by e-mail.

4.1 Guest account

Customers can order in the shop without creating a permanent account. This so-called guest account will be deleted automatically after a successful order or if customers log off.

The guest account will remain, if the check-out will be interrupted e.g. by closing the browser window. The site administrators delete those guest accounts manually usually within 48 hours.

4.2 Customer account

If a customer account will be created, customers may additionally

  • create an address book,
  • activate the quick purchase function and save their preferred billing and delivery address along with shipping and payment method,
  • see the current order status in their account,
  • have access to their complete order history, and
  • may rate products.

4.3 Customer account with PayPal data

When customers use PayPal Express for the purchase (through the button "checkout with PayPal" on the shopping cart page), private data will be imported from the PayPal account. These data can be edited before submitting the order. Note: The purchase will not be completed in PayPal.

Additionally, a customer account will be created in the Moore than Spice shop. Customers define a password through the link in the order confirmation or by using the "Forgot password" function.

5. Payment

The following methods of payment are possible and free of charge for the customer:

  • SEPA bank transfer (advance payment)
  • and these PayPal payment options:
    • PayPal
    • Direct debit
    • Credit card (VISA, Mastercard, American Express)
    • Pay upon invoice
    • Sofortüberweisung
    • Giropay

6. Shipping and delivery

6.1 Shipping

Orders are usually shipped as parcels with DHL within Germany and DPD to Belgium and the Netherlands. In rare cases, orders will be shipped with a different company than chosen by the customer.

Several ordered items are usually combined into one shipment. Delivery to a DHL Packstation is possible. On request, shipping with Hermes, DPD or UPS (with surcharge) can be arranged.

With pickup by the customer, the designated shipping costs do not apply. A self-collection is possible only after previously agreed collection date and time.

6.2 Delivery time

Delivery of ordered goods will take place in Germany within the period of working days (Monday to Friday, excluding holidays) specified in the item description after the payment order is provided to the remitting bank or after submitting measurements (if necessary), whichever is the later date.

Delivery period given at products to be produced includes an average production time and necessary buffer time. The production time varies according to the current work-load situation, amount of effort and ordered items, washing and drying phases, etc. Thus result different delivery periods.

Additionally, the delivery period extends in these cases:

  • For delivery to Belgium, or the Netherlands by 2 to 3 working days.
  • For garment tailored to customer's measurements by 2 to 5 working days.
  • When selecting organic fabrics from our cooperation partner stoffbotin.de by 4 to 7 working days.
  • When ordering several items, the delivery time sums up accordingly.
  • Because of e. g. holidays. Duration will be announced on the page Delivery time.

6.3 Undeliverable

All orders will be delivered to delivery address provided by customer on order form. If delivery to the purchaser is not possible, for example because the customer is not present at the specified delivery address, the customer bears the costs of the unsuccessful delivery and return to Christian Moore.

Returned goods made according to the individual choice by the consumer will not be refunded, but another delivery can be arranged at the thereby incurring costs.

At unsuccessful delivery and without clarifying of the correct address, further orders may not be accepted by Christian Moore.

7. Guarantee and complaints

Deliveries of Christian Moore have to be scrutinized for their correctness immediately upon receipt. Insufficient or incorrect deliveries and any defects have to be reported in writing within seven days to Christian Moore (e-mail address: shop@mooredenim.com). To include: the invoice number, an explanation, and photographic evidence.

Failure to complete this complaint has no consequences on legal rights. The warranty period for consumers is 2 years from receipt of goods. During this period, the statutory warranty rights apply.

Minor deviations of received items from illustrated products in the online shop may be technically limited by the on-screen display or caused in the production process. These deviations can not be rejected. In particular, washing effects always vary to some degree since a manual method is used and this is part of the individual character of the ordered goods.

Non-delivery of a shipment must be reported in writing within three months after the order date (e-mail address: shop@mooredenim.com).

8. Rating system

The online shop of Christian Moore has a rating system that serves to facilitate the purchase decision for other customers with assessments and recommendations.

Customers are advised to only provide truthful and factual information that are connected with the settlement of the purchase contract and the assessment of the products. Reviews may not contain defamatory comments and must be based on sufficient factual basis and the common law.

A client who decides to provide content (e.g. customer reviews) to www.mooredenim.com or corporate pages on e.g. Twitter or Facebook grants Christian Moore for the duration of the underlying law unrestricted in time and place the exclusive license for the further use of the content for any purpose online and offline. Christian Moore will endeavor to appoint the author of all times (unless he has indicated his intention to remain anonymous), but reserves the right to shorten or omit this information. Christian Moore reserves the right to show content not or only for a limited period on the website as well as to shorten or change content, especially if there are concrete indications of a breach of the terms and conditions or applicable law. A claim for recovery of deleted reviews does not exist.

Content provided by customers, including customer reviews, only give the opinion of the customer. The contents may not necessarily agree with the opinion of Christian Moore.

9. Termination/cancellation of the customer account

Registered customers can delete their account at any time in their members area.

In addition a termination notice may be directed in writing to Christian Moore, and the data will be deleted. Sufficient explanation for the cancellation is a written notice to:

Christian Moore reserves the right to delete customer accounts if:

a) a customer gives wrong contact details, especially an incorrect or invalid e-mail address,
b) transfers his account to a third person,
c) the customer hasn't logged in/used his customer account within the last five years or
c) MOORE DENIM finds it necessary due to fraud, waste, or abuse.

10. Trademark, copyright

The content and works provided on these pages (www.mooredenim.com) are subject to German copyright law. The reproduction, modification, distribution, or any kind of exploitation outside the limits of copyright require the written consent of the author or creator. Downloads and copies are permitted only for personal, noncommercial use.

The operator of this website minds copyrights for content on this site that is not created by the operator. Should you become aware of (copy-)right infringement, I kindly ask for a hint. Upon notification of violations, I will remove the content immediately.

11. Governing law and jurisdiction

These conditions are governed by and construed in accordance with the German laws. You agree, as I do, to submit to the non-exclusive jurisdiction of the courts of the district of Bochum City, Germany.

12. Severability clause

Should any of the terms and conditions of this or any conditions in further agreements become invalid, this shall not affect the validity of agreed upon conditions in-whole. If necessary, the invalid condition/s will be replaced with the valid most similar to the economic meaning and purpose in standing agreement.
